PLEASE READ CAREFULLY THIS IS A BINDING LEGAL AGREEMENT
This is a legal agreement (the Agreement) between you, the end-user (student, user, you, your) and SafetyVantage Inc. (SafetyVantage, we, us or our) setting out the terms and conditions for your use of our online learning platform (course), for the display of content and the specific third-party content you have ordered a license to (collectively, the Product).
THIS AGREEMENT CONTAINS WARRANTY AND LIABILITY DISCLAIMERS. IN ORDER FOR YOU TO HAVE ACCESS TO THE PRODUCT, THIS AGREEMENT MUST BE ACCEPTED BY YOU WITHOUT ANY MODIFICATIONS, ADDITIONS, OR DELETIONS. IF YOU DO NOT AGREE TO OR CANNOT COMPLY WITH THE TERMS CONTAINED IN THIS AGREEMENT, YOU MUST REJECT THESE TERMS AND NOT USE THE PRODUCT

Certificate of Completion
A certificate from SafetyVantage online learning does not guarantee that a student possesses a minimum level of skills or knowledge regarding the subject matter. It is the employer’s responsibility to assess the employee’s level of skill or competency and determine whether an employee is qualified to perform a specific job or function.
Limit of Liability
By registering for this course, the student and the student’s employer agree that SafetyVantage shall not be held liable for any type of loss or damage that could be construed as arising from this course. SafetyVantage does not take any responsibility for inappropriate use or application of information or instruction provided in this course.

At certain places on the SafetyVantage website there are links to other Internet sites. Such external Internet sites contain information created, published, maintained, or otherwise posted by institutions or organizations independent of SafetyVantage. SafetyVantage does not endorse, approve, certify, or control external Internet sites and does not guarantee the accuracy, completeness efficiency, timeliness or correctness of the information located at the sites. Reference herein to any specific commercial product, process or service by trade name, trademark, service mark, and manufacturer or otherwise does not constitute or imply endorsement, recommendation or favouring.
Copyright
All material contained on the SafetyVantage site is protected by copyright law. The student and the student’s employer agree not to copy or distribute any materials contained on the SafetyVantage website. All comments, suggestions, ideas, notes, drawings, concepts, or other information disclosed or offered to SafetyVantage by this site, or in response to solicitations from this site (collectively, the Comments) shall remain the property of SafetyVantage. None of the Comments shall be subject to any obligation of confidence on the part of SafetyVantage, and SafetyVantage shall not be liable for any use or disclosure of the Comments. Without limitation of the foregoing, SafetyVantage shall exclusively own all now known or hereafter existing rights to the Comments of every kind and nature throughout the world and shall be entitled to unrestricted use of the Comments for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Comments.
Communications made through this site’s e-mail and messaging system is for convenience only and shall not be deemed to constitute legal notice to SafetyVantage or any of its officers, agents, agencies, employees or representatives with respect to any existing or potential claim or cause of actions or for any other purpose.
Honour Code
SafetyVantage trusts in the integrity of the student to observe the honour code. The honour code is based on the assumption that the student will be honest when taking an exam. The student agrees that only he or she will take the exams and complete required exercises and that he or she will not make copies nor distribute or share exam questions or provide answers to other students enrolled in the course. In the event that SafetyVantage is made aware of an incident(s) of fraudulent certificates or fraudulent processes to obtain a certificate SafetyVantage will investigate the incident and if found to be fraudulent will revoke all access of those individuals to the learning management system, will notify appropriate industry groups and partners of the offense and will deny the authenticity of any certificate(s) obtained through these fraudulent processes upon a Verification Request pertaining to the certificates in question. For more certainty in the event of any offence related to the Ground Disturbance Standard 201 training, SafetyVantage will advise the Utility Safety Partners (USP) of all such offences.
Passwords
Students may not disclose or share their password with others, and will notify SafetyVantage if he or she believes that someone has learned their passwords. In the event that a password is lost and a replacement password is required, SafetyVantage will not disclose or transmit any login credentials or password reset instructions to any individual other than by email to the email address of the user and/or the purchaser of the online learning instance.
Replacement Certificates
Students may not alter any certificate of completion generated by SafetyVantage. In the event that an electronic certificate issued by SafetyVantage is lost and a replacement is required the student must log in to the SafetyVantage system to obtain a replacement electronic certificate. SafetyVantage will not disclose or transmit any electronic certificate to any individual other than by email to the email address of the user and/or the purchaser of the online learning instance
Privacy and Verification
The personal and business information collected during the student’s registration, purchase and completion of any online learning content is subject to the SafetyVantage corporate Privacy Statement. If a third party wishes to verify the authenticity of an electronic certificate issued by SafetyVantage (Verification Request), such a third party must provide all the information listed on the certificate, including, but not limited to, student name, date of issue, certificate number, expiry date to SafetyVantage upon request. SafetyVantage will only confirm or deny the authenticity of an electronic certificate issued by SafetyVantage based on the information provided by the third party during a Verification Request and will not disclose any additional information to the third party.
Refund Policy
Customers are entitled to a 100% refund on any purchase provided that all of the following criteria are met:
- A Refund is requested within 30 calendar days of the date of purchase by contacting Support@SafetyVantage.com.
- No more than 50% of the eLearning lessons within any course have been accessed (or started).
- The exam questions have not been accessed.
- A certificate of completion has not been issued.
In the case of enrollment keys and the purchase of multiple courses only those courses that do not meet the criteria listed above qualify for a refund.
Third-Party Curriculum
The following courses offered to the public by SafetyVantage have been developed and licensed to SafetyVantage by third parties:
- Certified Health & Safety Representative (CHSR)TM Certification developed by the Alberta Association of Safety Partnerships
- Qualified Health & Safety Officer (QHSO)TM Designation developed by the Alberta Association of Safety Partnerships
- Certified Health & Safety Auditor – Internal (CHSA-I)TM Certification developed by the Alberta Association of Safety Partnerships
While SafetyVantage endeavours to ensure that the third party courses meet the industry standards and legal requirements, SafetyVantage offers these courses under a license agreement with the third parties, and therefore assumes no legal liability or responsibility for the legal or copyright compliance of any information contained in the materials associated with these courses. In no event shall SafetyVantage be liable for any special, indirect or consequential damages or any damages whatsoever, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the legal or copyright non-compliance of these third party courses content.
